Article 4 direction documentation

An Article 4 direction, removes or restricts permitted development rights within an area of acknowledged importance.  Permitted development rights are described in the The Town and Country Planning (General Permitted Development) (England) Order 2015

The removed/restricted permitted development rights are detailed in a Schedule, as part of a Notice, which then becomes enforceable once confirmed after a period of consultation. 

A planning application has to be submitted for a site in the area when development includes removed or restricted permitted development rights.

Licence

This dataset has been published by New Forest District Council under the Open Government Licence  Open Government Licence (nationalarchives.gov.uk). This licence has been applied following the Public Sector Geospatial Agreement 'presumption to publish' process.

ART4/66/00002:  ARTICLE 4 DIRECTION 97/5, Land in the Avon Valley Christchurch

ARTICLE 4 DIRECTION 97/5 was made on 2 September 1966 and confirmed 3 November 1966, under Article 4 of the Town and County Planning General development order, 1963. 

Hampshire County Council was the planning authority for the Direction.

Directing that permission granted by Article 3 of the said order shall not apply to development specified in Classes IV(2), VI(1) and XXII.

ART4/66/00001: ARTICLE 4 DIRECTION 97/3,  Land situated at Bransgore House, Bransgore

This Article 4 direction area straddles the boundary with the New Forest National Park Authority.

ARTICLE 4 DIRECTION 97/3 was made on 14 February 1966 and confirmed 20 April 1967, under Article 4 of the Town and County Planning General development order, 1963. 

Hampshire County Council was the planning authority for the Direction.

Directing that permission granted by Article 3 of the said order shall not apply to development specified in Classes II(1), VI(1) and XXII (means of enclosure, temporary use and siting of caravans).

ART4/71/00001: ARTICLE 4 DIRECTION 97/6, Land at Furzedown Farm, Frost Lane, Hythe

ARTICLE 4 DIRECTION  was made on 15 March 1971 and confirmed 27 May 1971, under Article 4 of the Town and County Planning General development order, 1963.

The Rural District Council of New Forest was the planning authority for the Direction.

Directing that permission granted by Article 3 of the said order shall not apply to development specified in Class VI(1) (building or engineering operations requisite for the use of that land for the purposes of agriculture)

ART4/72/00001: ARTICLE 4 DIRECTION 97/1, Coast along the Solent and Southampton Water

This Article 4 direction area straddles the boundary with the New Forest National Park Authority.

ARTICLE 4 DIRECTION  was made on 19 November 1971, confirmed on 6 December 1972 and registered on 10 January 1973, under Article 4 of the Town and County Planning General development order, 1963.

Hampshire County Council was the planning authority for the Direction.

Directing that permission granted by Article 3 of the said order shall not apply to development specified in Class IV (restricting the use of hovercraft within approximately one mile of the coast and estuaries taking in Southampton Water, and land within approximately one mile of any point on the Beaulieu and Lymington Rivers up to and including the respective townships).

ART4/82/00001: ARTICLE 4 DIRECTION 97/2, Land in Avon Valley

 This Article 4 direction area straddles the boundary with the New Forest National Park Authority.

ARTICLE 4 DIRECTION was made on 19 August 1982 and provisionally identified as confirmed 17 November 1982 (we do not have access to a document source that provides evidence of the confirmation date), under Article 4 of the Town and County Planning General development order, 1977.

New Forest District Council was the planning authority for the Direction.

Directing that permission granted by Article 3 of the said order shall not apply to development specified in Class IV ( the carrying out on the said land of works for the excavation and construction of fish farms or agricultural reservoirs on land in the Avon Valley, Hampshire)

ART4/15/00001: ARTICLE 4 DIRECTION MARL/PUDDLE,  Land adjoining  Marl and Puddleslosh Lanes (Comprising approximately 26 hectares), north of Fordingbridge

ARTICLE 4 DIRECTION was made on 27 October 2014 and confirmed with an amendment on 13 April 2015, under article 4(1) of the Town and Country Planning (General
Permitted Development) Order 1995 ( as amended).

New Forest District Council was the planning authority for the Direction.

The Direction withdraws permitted development rights as follows:  the erection, construction, improvement or alteration of a gate, fence, wall or other means of enclosure being development comprised within Class A of Part 2 of Schedule 2 to the Order and not being development comprised within any other class.

 Note in July 2023 further permitted development was introduced that nullified this directive, leading to the ART4/23/00001 direction.
